Terms and Conditions

These Terms and Conditions govern the use of the AI-powered photo restoration, enhancement and editing service provided by Marc Granell Beltrán (trading as "Naiara AI") through the website ("the Site", "the Service"). By creating an account or using the Service, you agree to be bound by these Terms, the Privacy Policy and the Cookie Policy.

The Service lets you upload photos and apply various AI-powered enhancements to them: damage restoration, resolution upscaling, colourisation, removal of people or objects, and photographic filters.

The Service works on a credit system: each restoration action consumes 1 credit, regardless of the type of enhancement applied. Your first restoration is free when you create an account.

There is no subscription: credits are bought in one-time-payment packs that never expire.

To use the Service you must create an account, providing accurate information, and be 18 or over. You are responsible for keeping your password confidential and for all activity carried out from your account.

Credit packs are paid for with a single one-time payment via Stripe. Prices are shown in euros, taxes included where applicable, before you confirm the purchase. Your credit balance is added to your account immediately once payment is confirmed.

Under EU consumer-protection rules, you would generally have a 14-calendar-day period to withdraw from a digital content purchase without needing to give a reason.

However, because credits are delivered immediately and can be used instantly after payment, before completing payment we will ask for your express consent to the immediate supply of the digital content and your express waiver of the withdrawal right, under Article 103.m) of the recast Spanish General Law for the Protection of Consumers and Users. If you do not check that box, you will not be able to complete the purchase.

If a restoration result isn't satisfactory, you can file a complaint from your restoration history, stating the reason. We review every complaint individually and, where appropriate, refund the credit spent on that action.

By using the Service, you agree not to upload photos of other people without their consent; not to use the Service to generate illegal, defamatory, discriminatory content, or content that infringes third parties' intellectual property, image or privacy rights; and not to attempt to breach the Site's security or use the Service in an automated way without authorisation.

Breach of these conditions may result in the suspension or cancellation of your account, without prejudice to any other legal action that may apply.

You retain ownership of the photos you upload and of the results generated. You grant us a limited, non-exclusive, revocable licence to process those photos solely to provide you the Service. We will not use your images for any purpose other than providing the Service unless you expressly authorise us to do so.

We do everything reasonably possible to keep the Service available and working correctly, but we cannot guarantee uninterrupted availability, particularly regarding third-party services we depend on (AI image processing, payment gateway).

To the extent permitted by applicable law, we are not liable for indirect damages arising from use of the Service. Nothing in these Terms limits the rights that consumer-protection law mandatorily grants to users who qualify as consumers.

You can close your account at any time from your account settings. We may suspend or cancel your account if you breach these Terms, with prior notice except in serious or urgent cases.

We may amend these Terms to reflect legal changes or changes to the Service. We will inform you of any material change, and if you continue using the Service afterwards, you will be deemed to accept it.

These Terms are governed by Spanish law. If you are a consumer resident in the European Union, you can access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

For any dispute not resolved this way, the parties submit to the Courts of Valencia (Spain), except where mandatory consumer-protection rules establish a different jurisdiction.
